1. About Nia Gleam

Nia Gleam ("we", "us", "our") is an online boutique based in Nairobi, Kenya. We curate and resell jewelry, handbags, and accessories sourced from third-party suppliers. By placing an order on our website, you ("the customer") agree to these terms in full.

2. Product Descriptions & Authenticity

We make every effort to describe and photograph our products accurately. However, slight variations in colour, size, or finish may occur between what is shown on screen and the physical item due to lighting, display settings, and the handcrafted nature of certain products.

Important: Our products are sourced from third-party suppliers. Where brand names, logos, or trademarks appear in product descriptions or on the items themselves, they are used solely for identification and descriptive purposes. Nia Gleam does not claim to be an authorised dealer, distributor, or affiliate of any third-party brand. We do not guarantee or make any representations regarding the authenticity of branded items. All brand names and trademarks are the property of their respective owners.

By purchasing from us, you acknowledge and accept that products may not be original branded goods and that you are buying the item as described and photographed on our website.

3. Returns & Exchanges

We do not offer refunds. All sales are final.

We do offer exchanges under the following conditions:

  • You contact us within 48 hours of receiving your order via WhatsApp or email.
  • The item is unworn, unused, and in its original condition with all tags and packaging intact.
  • You provide clear photos of the item and the reason for the exchange.
  • The cost of return shipping is borne by the customer unless the item arrived damaged or is materially different from what was described.
  • Exchanges are subject to stock availability. If the requested replacement is unavailable, we will offer a store credit valid for 90 days.

Items that show signs of wear, alteration, perfume application, or damage caused by the customer are not eligible for exchange.

4. Damaged or Incorrect Items

If your order arrives damaged during transit or you receive an item that is materially different from what you ordered, please contact us within 48 hours of delivery with photos of the issue. We will arrange a replacement at no extra cost, or issue a store credit if a replacement is not available.

5. Pricing & Payments

All prices are listed in Kenya Shillings (KES) and include VAT where applicable. Delivery fees are calculated separately and displayed at checkout.

We accept payments via M-PESA, Visa, and Mastercard. Card payments are processed securely through Paystack, a PCI-DSS compliant payment provider. We do not store your card details. M-PESA transactions are processed through Safaricom's secure network.

An order is only confirmed once payment has been successfully received. We reserve the right to cancel any order where payment cannot be verified.

6. Delivery

We deliver within Kenya using third-party courier services. Estimated delivery times are provided at checkout but are not guaranteed, as they depend on your location and the courier's schedule.

Risk of loss: Once an order has been handed to the courier and marked as dispatched, the risk of loss or damage during transit passes to the customer. While we will do our best to assist with courier claims, we are not liable for packages that are lost, stolen, or damaged by the delivery service after dispatch.

Please ensure your delivery address and phone number are accurate. We are not responsible for failed deliveries due to incorrect customer information.

7. Limitation of Liability

To the maximum extent permitted by Kenyan law:

  • Nia Gleam is not liable for any allergic reactions, skin irritation, or adverse effects resulting from the use of our products. Customers with sensitive skin or known allergies should review product materials before purchasing.
  • We are not liable for normal wear and tear, tarnishing, or discolouration that occurs over time with regular use of jewelry and accessories.
  • Our total liability for any claim related to a purchase shall not exceed the amount you paid for that specific item.
  • We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

8. Intellectual Property

All content on this website — including text, images, logos, and design — is the property of Nia Gleam or used with permission and is protected under Kenyan intellectual property law. You may not reproduce, distribute, or use any content from this site without our written consent.

Third-party brand names, logos, and trademarks referenced on this site belong to their respective owners and are used for product identification only. Their use does not imply endorsement, sponsorship, or affiliation with Nia Gleam.

9. Privacy & Data

When you place an order, we collect your name, phone number, email address, and delivery address. This information is used solely for:

  • Processing and delivering your order.
  • Sending order updates via SMS, WhatsApp, or email.
  • Contacting you about your order if needed.

We do not sell, rent, or share your personal information with third parties for marketing purposes. Payment data is handled securely by our payment providers (Paystack and Safaricom) and is never stored on our servers.

We may retain order records for accounting and legal compliance purposes as required under Kenyan law.

10. Order Cancellation

You may request to cancel an order before it has been packed by contacting us via WhatsApp. Once an order has been packed or dispatched, it cannot be cancelled — please refer to our exchange policy in Section 3.

We reserve the right to cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, or stock unavailability. In such cases, a store credit or M-PESA reversal will be issued.

11. Modifications to These Terms

We may update these terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.

12. Governing Law & Disputes

These terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
